1. General Information
CyberCat VPN (the "Service") is provided by Smooth OÜ, a private limited company registered in Estonia (registry code 12695065, VAT number EE102946017), Lai tn 32-4, 10133 Tallinn, Estonia ("CyberCat", "we", "us"). You can contact us at meow@cybercatvpn.com.
These Terms and Conditions ("Terms") govern your use of the Service, including our website, your CyberCat account, and our apps, and any subscription you buy from us. By creating an account, buying a subscription or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer protection law of your country of residence.
2. Our Responsibilities
We provide the Service with reasonable care and skill and in line with its description at the time you buy it. If you are a consumer and the Service does not conform to our contract with you, you have the legal remedies available to you under applicable law, including having the issue fixed, a price reduction or ending the contract. These Terms do not limit those remedies.
We aim to keep the Service available 24 hours a day. We may need to interrupt it for maintenance, security or reasons beyond our control. We keep such interruptions as short as reasonably possible and, where we can, announce planned maintenance in advance.
We are not responsible for:
- 2.1 Faults in internet access, mobile networks, browsers, devices or software that we do not control;
- 2.2 Viruses or other harmful code on the device you use the Service on, unless we caused them;
- 2.3 Unauthorized access to your devices or accounts that results from your own failure to keep them secure;
- 2.4 Content provided by third parties that you access through the Service;
- 2.5 Loss that was not reasonably foreseeable when you started using the Service.
Nothing in these Terms excludes or limits our liability for intent or gross negligence, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited by law.
3. Your Responsibilities
Age. If you live in the European Union, you must be at least 16 years old to use the Service. If you live anywhere else, you must be at least 13 years old. If you are not old enough to legally agree to these Terms in your country, your parent or guardian must agree on your behalf.
When using the Service, you agree to:
- 3.1 Use the Service for personal, non-commercial purposes only, and comply with all laws that apply to you;
- 3.2 Not use the Service for illegal activity, including copyright infringement, or to gain unauthorized access to any network, server or computer system;
- 3.3 Keep your password and login credentials confidential;
- 3.4 Tell us promptly if you notice unauthorized use of your account or a breach of security;
- 3.5 Provide true, accurate and current information when you register.
You are responsible for activity under your account that results from your breach of these Terms or from your failure to keep your login credentials secure.
4. Subscriptions, Payments and Taxes
- 4.1 Prices. Prices are shown in the listed currency. VAT, sales tax and similar taxes depend on your billing country, which we only know once you enter it at checkout, so the prices on our plan pages do not include them. Where such taxes apply, the applicable rate and amount are shown at checkout and added to the price.
- 4.2 Taxes. Where applicable, VAT or sales tax is calculated at checkout based on your billing country and added to the price. The total amount, including tax, is shown before you pay.
- 4.3 Automatic renewal. Subscriptions renew automatically at the end of each billing period at the regular price of your plan (plus VAT/tax where applicable) until you cancel. Introductory discounts and promo codes apply to the first billing period only unless stated otherwise.
- 4.4 Cancellation. You can turn off automatic renewal at any time in your account. You keep access until the end of the period you have paid for.
- 4.5 Price changes. If we change the renewal price of your plan, we will notify you by email before the new price applies, and you can cancel before it takes effect.
- 4.6 Refunds. You can withdraw from a new subscription within 14 days as described in section 5. In addition, our Refund Policy gives the first subscription a 30-day money-back guarantee, including upgrades in that window, and gives each automatic renewal charge a 14-day refund. An account can receive two refunds under that policy. Section 5 is separate and is not limited by that count.
- 4.7 App store purchases. Subscriptions bought through the Apple App Store or another app store are billed, renewed and refunded by that store under its own terms.
5. Right of Withdrawal
If you are a consumer, you can withdraw from a subscription bought on our website within 14 days of the day you bought it, without giving any reason.
To withdraw, tell us clearly that you want to withdraw before the 14 days end. You can:
- use the Request a Refund button on your subscription in your account dashboard, where available;
- email us at meow@cybercatvpn.com; or
- send us the model withdrawal form below. Using it is optional.
Effects of withdrawal. If you withdraw, we refund all payments received from you for that subscription, including taxes, without undue delay and no later than 14 days after we receive your withdrawal. We use the same payment method you used for the purchase unless you agree otherwise, and you will not be charged any fees for the refund. Your subscription ends when the withdrawal is processed.
